Kegagalan Regulasi Pengelolaan Pasar Tradisional dalam Mengonstruksi Kewajiban Lingkungan Perusahaan: Prespektif Extended Producer Responsibility dan Corporate Enviromental Liability

Abstract

The increasing volume of waste generated in traditional markets remains one of the unresolved environmental issues in Indonesia. Existing traditional market management regulations primarily focus on the responsibilities of local governments and market operators, while the involvement of producers contributing to post-consumer waste remains limited. This study aims to analyze the failure of traditional market management regulations in constructing corporate environmental obligations from the perspectives of Extended Producer Responsibility (EPR) and Corporate Environmental Liability (CEL). This research employs a normative legal research method using statutory, conceptual, and comparative approaches. Data were collected through literature studies involving laws and regulations, legal doctrines, scientific journals, and policy documents. The findings indicate that traditional market management regulations in Indonesia remain downstream-oriented and have not comprehensively integrated producer responsibility principles. Regulatory weaknesses are reflected in the absence of effective mechanisms to impose obligations on producers regarding waste reduction, collection, and management of product packaging commonly found in traditional markets. Furthermore, the concept of Corporate Environmental Liability has not been adequately implemented within the market management regime, creating a gap in environmental accountability. This study recommends reformulating traditional market management policies by integrating EPR and CEL principles to strengthen corporate environmental accountability and support sustainable development.
